Civil Rights Victory — United Airlines Agrees to Stop Race- and Sex-Based Discrimination in Hiring

America First Legal (AFL) asked the U.S. Department of Labor’s Office of Federal Contract Compliance Programs in January to investigate United Airlines over race- and sex-based quotas, preferences, and set-asides in hiring and contracting.

AFL stated in the complaint that federal law “requires all federal
government contracts to include an equal opportunity clause prohibiting the contractor from discriminating against an employee or an applicant for employment because of race, color, religion, sex, or national origin.”

But United Airlines, AFL noted, violated this requirement. For example, CEO Scott Kirby described diversity quotas in the airline’s training academy in an interview on June 20, 2021. An excerpt:

He further described that “for every job, when we do an interview, we require women or people of color to be involved in the interview process.” Kirby confirmed that, at the time of the interview, “only” 19% of United pilots were women and people of color. Increasing diversity among pilots accordingly entails refusing to consider or hire qualified nonminority pilots.

The Department of Labor’s compliance office apparently did its job. It held an informal compliance conference on election day last Tuesday, and United Airlines agreed to end illegal hiring practices.

AFL’s president is Stephen Miller, who served in President-elect Donald Trump’s previous administration as a senior adviser. Miller is expected to serve as deputy chief of staff for policy in the second administration.

Gene Hamilton, AFL’s vice president, said that Americans deserve equal treatment under the law.

“Yet in recent years, major corporations made the asinine decision to stop treating Americans as individuals who should be assessed on their own individual merit, and instead decided that judging Americans based on the color of their skin was the better path to making employment decisions.”
