Title IX of the federal code bars sex discrimination in any school or education program that accepts federal money for taxpayers. This law is one of the reasons girls and women have athletic teams on par with those of boys and men. But allowing males to compete against females on sports teams deprives girls and women of their guaranteed equal opportunities.
A three-judge panel of the U.S. Court of Appeals for the Second Circuit in December ruled against a group of female athletes who sued an athletic association in Connecticut over a policy that allowed males to compete against them on the girls’ team. Unable to outrun boys, these girls lost races and didn’t qualify for championships.
The litigation road has been long for Selina Soule, Alanna Smith, Chelsea Mitchell, and Ashley Nicoletti. A federal judge dismissed their lawsuit, and the three-judge panel affirmed the decision. The panel even used the offensive word “cisgender” to refer to these normal women.
The women asked the full court to rehear their case. Alliance Defending Freedom (ADF), which represents these women, announced that the full 2nd Circuit has agreed to hear arguments.
“We’re pleased the 2nd Circuit has decided to rehear this important case, and we urge the court to protect women’s athletic opportunities,” ADF senior counsel Christiana Kiefer said. “Eighteen states have enacted laws that protect women and girls from having to compete against males, and polls show that a majority of Americans agree that the competition is no longer fair when males are permitted to compete in women’s sports.”
Soule said that because of the Connecticut policy, she failed to qualify for the 2019 state championship and the 55-meter dash because the two boys, naturally larger, stronger, and faster, beat her in the race. She said she competed against them over a dozen times and lost. Smith said that it was “demoralizing” to compete against two boys, knowing all her hard work wasn’t going to pay off.
