This Court Just Denied CBS’s Motion to Dismiss Racial Discrimination Lawsuit

Brian Beneker was a script coordinator and freelance scriptwriter for CBS who sought a permanent job as a staff writer. According to America First Legal (AFL), CBS hired and promoted people who lacked experience and screenwriting credits but qualified as members of favored groups — everyone except heterosexual white men.

After CBS hired a black man with less experience than Beneker, he asked his supervisor why, and the supervisor said because the man was black.

AFL filed a lawsuit in federal court on Beneker’s behalf in February on the grounds that CBS violated the Civil Rights Act of 1964.

CBS asked the court to dismiss the lawsuit. The court rejected the request last week.

“The Court concludes that the issues raised by Defendant are more appropriately resolved on a motion for summary judgment.”

This is bad news for CBS if the corporation did, in fact, discriminate against Beneker based on the color of his skin. From ADF (emphasis added):

The Court’s rejection of CBS’s attempt to dismiss the case is a significant development. AFL now can engage in extensive discovery to obtain and reveal evidence of CBS’s employment practices, and its alleged discrimination against AFL’s client, and can then use that information to vindicate his rights in court at trial.

Beneker asks for actual, compensatory, and punitive damages.
