A Female Athlete and a Christian Teachers Group Urges a Federal Court to STOP Biden’s ‘Transgender’ Mandate

Alliance Defending Freedom (ADF) filed a motion on behalf of a female high school athlete from West Virginia and an association of teachers called Christian Educators Association International in State of Tennessee v. Cardona against the U.S. Department of Education over its “reinterpretation” of federal anti-discrimination law to allow boys and men with sexual fantasies of being girls and women free access to their restrooms and changing rooms.

The change goes into effective on August 1.

The Biden administration, which does not have the authority to change federal law, eventually will finalize a rule to allow such boys to ruin girls’ sports teams. Several states have filed lawsuits to stop enforcement of the changes.

The U.S. Congress created Title IX in the 1970s to protect equal opportunities for girls in education, which covered fair competition in sports.

“Fifty years ago, Congress revolutionized our educational system,” ADF wrote (PDF) in the complaint. But the Biden administration’s “transgender” mandate is a different sort of revolution.

“The result is that Title IX’s primary beneficiaries are denied the privacy, dignity, equality, and fairness needed to benefit from our educational system.”

The Biden administration loves to cite Bostock v. Clayton County (2020) to justify undermining girls. Why? Because the decision went leftists’ way, and three Trump-appointed justices voted with leftist judges. In fact, Justice Neil Gorsuch wrote the majority opinion. The conservative-majority court ruled that the Civil Rights Act of 1964 protects employees from discrimination based on sexual orientation and “gender identity.”

Bostock involved a funeral home director who wanted to present as a woman at work. The owner, a Christian, thought that would be undignified and too upsetting to customers in such a setting, where they came to mourn and to bury loved ones. But the high court knew better than an experienced funeral home owner.

Justices Sam Alito, Clarence Thomas, and Brett Kavanaugh dissented.

The ADF asked the court in State of Tennessee v. Cardona to block the mandate while the case proceeds.

“While the administration claims this change won’t affect sports, it has already made its position clear that men who identify as women should compete in women’s sports under Title IX,” ADF said. “In fact, the administration has supported a male student’s efforts to compete against our client and other girls in women’s sports in West Virginia.”
