American Airlines Agrees to Stop Discriminating on the Basis of Race and Sex in Employment

Another corporation has turned its back on racial discrimination in hiring.

America First Legal (AFL) asked the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) in January to investigate American Airlines for hiring, recruiting, and promoting individuals under diversity, equity, and inclusion (DEI), which is against the law.

From AFL’s complaint (emphasis added):

American Airlines openly acknowledges—even touts—its racial, sexual, and gender discrimination in its recruitment and hiring programs. American Airlines states on its website that “[d]iversity, equity, and inclusion (DEI) are foundational to the American Airlines culture and are embedded into the fabric of who we are as a company. We are the global leader in commercial aviation, and therefore must carry the banner around the world for DEI.

Federal law bars discrimination on the basis of race, color, religion, sex, and nation origin. But under DEI, the company openly violated the law.

AFL announced that at an informal conference held earlier this month, OFCCP found that American Airlines violated the Equal Protection cause. The company admitted discriminating against individuals on the basis of race and sex and will no longer do so.

Southwest Airlines recently agreed to end race- and sex-based hiring. United Airlines caved in November.

“American companies must return to using merit—not the desire to check a DEI box—to select the most skilled and qualified employees,” said Will Scolinos, ADF legal counsel. “American Airlines’ agreement with the OFCCP is AFL’s latest victory in our fight to put illegal discrimination on the no-fly list.”
