Lame-Duck Biden Administration Backs Down on Proposed Title IX Rule Changes That Would Put Girls in Danger

The Biden administration proposed a rule that would have allowed boys and men to play on girls’ and women’s sport teams, and vice versa, depriving girls and women of fair competition — and undermining their safety.

Congress created Title IX to bar sex-based discrimination in schools and educational programs that receive federal tax money. What began under the Obama administration continued under Biden. Federal agencies “re-interpreted” the word “sex” to include sexual orientation and “gender identity.” The rule, if finalized, would have effectively ended equal opportunity in female sports.

Alliance Defending Freedom (ADF) announced that the Biden administration has withdrawn the proposed rule.

“In light of the comments received and those various pending court cases, the Department has determined not to regulate on this issue at this time.”

Jonathan Scruggs, ADF senior counsel and vice president legal strategy, said the Biden administration’s decision to withdraw the proposed rule “merely reflects the views of the vast majority of Americans who believe that women’s sports should remain reserved for female athletes.”

But we have a long way to go. Leftists will continue violating women’s privacy and putting them in danger.

“That is why Alliance Defending Freedom will continue to fight to preserve women’s sports for women and why the U.S. Supreme Court should grant review in two pending cases, B.P.J. v. West Virginia State Board of Education and Hecox v. Little, where lower courts required women to compete against males,” Scruggs said. “So, while today represents a victory, there is still much work left to do to ensure women have fair play and equal opportunity in athletics.”

Various states and organizations filed lawsuits to stop the Department of Education’s mandate, and at least two federal courts issued injunctions. The Biden administration filed an emergency motion to the Supreme Court to temporarily allow enforcement, but the high court rejected the request.
