Governor Gavin Newsom of California signed a so-called pupils’ rights bill that allowed teachers to keep secrets from parents. This law was created to bar teachers from alerting parents that their children were undergoing a mental health crisis and peer pressure to pretend to be the opposite sex.
The law, which overturned previous parental notification policies, blocked schools from telling parents that students requested changes to their official or unofficial records.
The Liberty Justice Center filed a lawsuit on behalf of the Chino Valley Unified School District and several parents to stop enforcement. They contend that the law violates the First and Fourteenth Amendments of the U.S. Constitution and the federal Family Educational Rights and Privacy Act.
A court upheld the school district’s parental notification law, and California’s attorney general has not appealed the ruling. The Liberty Justice Center has declared a victory in the case. An excerpt:
Therefore, in a victory for parents’ rights, the Chino Valley Unified School District may continue to enforce its updated parental notification policy.
