Fifth Circuit: FCC Has No Right to Force Radio and TV Stations to Submit Employee Data About Race and Sex

The Federal Communications Commission (FCC) under Joe Biden wanted to collect information from radio and television stations about their employees in the form of a survey.

Inside Radio reported that the U.S. Court of Appeals for the Fifth Circuit ruled against the FCC. The court held that the FCC overstepped its authorities by reinstating Form 395-B filing to collect race, ethnicity, and sex data for each stations’ employees.

You don’t have to guess why the Biden administration wanted race and “gender” data. Bureaucrats sought to collect this information so the FCC could force these stations to discriminate on the basis of race and sex in the interest of diversity.

“The prior administration had elevated woke ideology over time-honored principles of freedom of speech and association,” said Mike Farris, general counsel at the National Religious Broadcasters. “The desire to use the power of government to gather information for no other legitimate governmental purpose but to harm the political opponents of regulated entities is utterly un-American. That threat is now behind us thanks to this decision from the Fifth Circuit.”

Inside Radio notes that the FCC likely won’t appeal. President Donald Trump’s administration will not tolerate race- and sex-based discrimination.
