Since President Trump’s inauguration, we have seen a disturbing trend of individual district court judges issuing nationwide injunctions that disrupt the implementation of federal policies. These sweeping rulings, often handed down by a single judge, threaten the constitutional balance of power by intruding into areas of congressional or presidential authority.
H.R. 1526, No Rogue Rulings Act, addresses this problem, enhances judicial restraint and reaffirms democratic principles. The Center for Urban Renewal and Education (CURE) is pleased to support this important legislation.
Former Attorney General Bill Barr says, “These district court judges are trying to usurp the responsibility of the president in the national security area. And what’s happening here is they’re trying to reduce all decisions to these trial-like hearings which essentially gives the judge the power to overrule and second-guess the executive.”
George Washington University law professor Jonathan Turley says, “I think that federal judges have overextended themselves. I think they have intruded into areas of Article II or presidential authority.” Turley goes on to say, “It’s like having a car where every passenger is grabbing the emergency brake. It’s pretty hard to drive that car.”
H.R. 1526 takes several important steps to restore balance to the judicial process, including:
• Restores principles of federalism by clarifying that judicial orders cannot bind nonparties to the litigation before the court.
• Stops one district court judge from dictating national policy—a constitutional authority reserved for Congress, the President, and, in limited instances, the Supreme Court.
• Creates an exception to the prohibition on judicial orders for certified class action lawsuits and establishes a three-judge process for cross-circuit state-led suits that are directly appealable to the Supreme Court.
The No Rogue Rulings Act takes the right approach to a vexing national problem and CURE urges you to support this vital legislation.
