Court Rules Against NY AG Letitia James — Pro-Life Pregnancy Centers Can Inform Women About Abortion Reversal

New York’s attorney general, Letitia James, is an abortion advocate who wants to stop pro-life pregnancy centers from sharing information about Abortion Pill Reversal (APR) services. She claims the centers give misleading and false information about APR.

James filed a lawsuit against several pregnancy centers in New York, and she’s facing three lawsuits herself. She attempted to have the cases moved to Manhattan from upstate New York, where most of the pregnancy centers reside. She lost.

The National Institute of Family and Life Advocates, Gianna’s House, and Options Care Center sued her for “abusing her authority by censoring pro-life pregnancy centers because they tell women about the option of using progesterone for abortion pill reversal.”

Alliance Defending Freedom (ADF), which represents the pregnancy centers, announced a recent ruling in the case. A federal court on Thursday issued a preliminary injunction, allowing the pregnancy centers to continue telling women about the option to reverse their abortions while the case is pending.

The court said (PDF) that the pregnancy centers are likely to succeed on the merits. The attorney general’s enforcement of the laws against the pregnancy centers, based on statements about abortion reversal, “is a content and viewpoint-based regulation on non-commercial speech that cannot survive strict scrutiny.”

ADF is pleased with the ruling.

“Many women regret their abortions, and some seek to stop the effects of abortion drugs before taking the second drug in the abortion drug process,” said Caleb Dalton, ADF senior counsel. “Taking supplemental progesterone may give them a chance to save their baby’s life.”
