Planned Parenthood’s New Argument to Crush South Carolina’s Pro-Life Law

The South Carolina Supreme Court ruled in 2023 that the state’s six-week ban on abortions did not violate the state constitution. The court previously ruled against a different version of the measure.

Now the justices will hear arguments again. This is Planned Parenthood’s third attempt to have a court strike down a law that protects the voiceless and vulnerable unborn in the Palmetto State.

The state’s Supreme Court will hear arguments on Wednesday.

Susan B. Anthony Pro-Life America said that Planned Parenthood’s new argument concerns “reinterpreting the science of fetal development to sell abortions later in pregnancy.” An excerpt (emphasis added):

In the lawsuit, Planned Parenthood challenges the consensus that a baby’s heart is beating at six weeks and claims that a fetal heartbeat instead begins at nine weeks. This is despite what the organization previously posted on its website for fetal development during the fifth and sixth weeks of gestation where they listed “a very basic beating heart and circulatory system develop.” At the same time, Planned Parenthood Action Fund says that a heartbeat does not begin until around 17-20 weeks of pregnancy.

The U.S. Supreme Court in 2022 ruled that the Constitution did not confer a right of privacy to kill unborn babies, overturning Roe v. Wade (1973) and Planned Parenthood v. Casey (1992). The abortion issue returned to the states.

South Carolina has one of the most restrictive abortion laws in the country, banning the procedure starting at six weeks. Women who seek to kill their babies must wait 24 hours after counseling. Only doctors can kill unborn babies, and women can’t use state Medicaid except in limited circumstances.

South Carolina also seeks to block state Medicaid funds to Planned Parenthood. The Supreme Court has agreed to hear the case.
