Tennessee lawmakers passed a bill to protect confused and peer-pressured children from puberty blockers, which could render them permanently sterile, and mutilating surgery to “change” their sex.
Governor Bill Lee signed the Save Adolescents from Experimentation Act in April. The law also restricts drag shows on public property or near schools.
Some of the minors filed a lawsuit to stop enforcement. A lower court issued a preliminary injunction, and Tennessee appealed. A three-judge panel of the U.S. Court of Appeals for the Sixth Circuit reversed the injunction. The opposing parties appealed to the U.S. Supreme Court.
The other side is fighting tooth and nail for the right of children, who can’t legally consent to contracts and many other things, but who can, pro-trans people think, legally consent to having their breasts cut off and their reproductive organs mutilated. Any adult who favors any of this for children is sick.
They’re definitely sick about what the Supreme Court just decided. The court this week upheld the state’s ban by a vote of 6-3. From Liberty Counsel:
Chief Justice John Roberts authored the majority opinion stating that the ruling was “only to ensure that” the law “does not violate” the Equal Protection clause.
“Having concluded that it does not, we leave questions regarding its policy to the people, their elected representatives, and the democratic process,” wrote Chief Justice Roberts. During oral arguments in December 2024, many of the Justices questioned whether the Due Process Clause or the Equal Protection Clause prohibited a state from banning gender transition surgery on minors, especially due to the lack of international medical consensus on gender procedures.
Twenty-six other states with similar laws to protect children can now cite this case in defense of their bans.
Gov. Lee also signed the Medical Ethics Defense Act into law in April. The measure bars the government from forcing a healthcare provider to participate in or pay for a procedure that conflicts with their religious beliefs.
