New Jersey’s pro-abortion attorney general, Matthew Platkin, does not want pro-life pregnancy centers administering a life-saving hormone to pregnant women who’ve taken life-ending drugs to kill their unborn babies.
First Choice is one of those pregnancy centers. This organization’s mission is to save unborn babies. First Choice provides free ultrasounds and testing for sexually-transmitted diseases, clothes for babies, and other services. First Choice also administers progesterone to counter the effects of the abortion drug mifepristone.
According to Alliance Defending Freedom (ADF), Platkin subpoenaed the pregnancy center to turn over private data in an investigation for possible violations of the New Jersey Consumer Fraud Act. Complying with the subpoena would tax their limited resources and violate the confidentiality of donors. The pregnancy center had already sent over 2,300 documents to comply.
First Choice asked the U.S. Supreme Court to allow it to sue the attorney general in federal court. The high court has agreed hear their case. From ADF:
“The First Amendment protects First Choice’s right to freely speak about its beliefs, exercise its faith, associate with like-minded individuals and organizations, and continue to provide its free services in a caring and compassionate environment to people facing unplanned pregnancies,” said Erin Hawley, ADF senior counsel. “The lower courts have wrongly held that First Choice is relegated to state court to present its constitutional claims. We are looking forward to presenting our case to the Supreme Court and urging it to hold that First Choice has the same right to federal court as any other civil rights plaintiff.”
