This Legal Organization Just Asked Congress to Investigate the Biden Admin for Racial Preferences at DOT

There was a time when black Americans simply wanted to be equal before the law. The righteous cause of the civil rights movement was about removing legal and social barriers for black Americans and allowing them to live as full and free citizens in the country of their birth — without special treatment.

Those days are long gone. Today, every special interest group you can think of wants a disproportionate share of the pie and unearned benefits to the detriment of others, and our federal government is happy to oblige.

The U.S. Department of Transportation has come up with a so-called Equity Action Plan to help “level the playing field.” Like affirmative action, this plan is a euphemism for plain, old, racial discrimination. Any policy or law that takes race into account when hiring, promoting, or firing is discriminatory.

Legal firm America First Legal (AFL) has raised the alarm, asking the Senate Committee on Homeland Security and Governmental Affairs, the House Committee on Oversight and Reform, the Office of Special Counsel, and the Equal Employment Opportunity Commission to open investigations into these illegal practices.

ADF also sent Secretary Pete Buttigieg a cease-and-desist letter (PDF). An excerpt:

AFL has obtained internal Department of Transportation documents 1 demonstrating that President Biden’s executive orders on “equity”2 are being implemented through unlawful “racial balancing” policies, practices, and quotas in employment training, hiring, and promotion. Furthermore, the Department’s publicly available “Equity Action Plan” demonstrates that race is being unlawfully infused into the Department’s procurement and grantmaking decisions.3

AFL calls the government’s equity policy a “taxpayer-funded exercise in racial ‘bean counting’ to support illegal race-based hiring and promotion practices.” AFL added that the plan is “redolent of Jim Crow,” illegal, and immoral.

ADF Vice-President and General Counsel Gene Hamilton said that the administration’s “unrepentant devotion to advancing ‘equity’ should alarm Americans everywhere.”

This devotion especially should alarm black Americans. A government that has the power to discriminate in your favor also has the power to discriminate against you.
