Why is the University of California System Still Discriminating Against Individuals Based on Race?

A group called Students Against Racial Discrimination recently filed a lawsuit against the University of California sued over the continued use of racial preferences in admissions.

Voters in California passed Proposition 209, known as the California Civil Rights Initiative, in 1996. The measure amended the state constitution to ban racial preferences in college admissions.

But California has tried to return to racial discrimination for years through so-called holistic admissions. The idea was to look at the “whole” person, which includes race. Any racial considerations in admissions are illegal in California.

Black and Hispanic enrollment in state schools dropped, naturally.

“To counteract this phenomenon, UC invested hundreds of millions of dollars in recruitment efforts,” according to the Wall Street Journal. “Despite an increase in applicants, admission rates among Black and Hispanic students remained low so the schools reactivated racial preferences, the suit contends.”

If admissions committees at the University of California are admitting blacks and Hispanics with lower scores than whites and Asians, they are violating the state constitution and federal law.

The U.S. Supreme Court ruled in 2023 that race-based admission policies at Harvard University and the University of North Carolina at Chapel Hill violated the U.S. Constitution.

President Donald Trump ordered that federal government agencies terminate so-called diversity, equity, and inclusion (DEI) policies. The ban includes federal contractors. The effect of the executive order is that private businesses are on notice to stop using race in hiring, promoting, and contracting decisions.

Star Parker, founder of the Center for Urban Renewal and Education, urged black Americans to check the facts about the president’s executive order before buying into the “racist” narrative.
