America First Legal (AFL), part of whose mission is to hold government bureaucrats accountable, just announced that Montgomery County Public Schools (MCPS) will have to pay up for violating the First Amendment.
AFL in 2023 filed a lawsuit on behalf of Matthew Foldi, a reporter for the Washington Free Beacon, and Bethany Mandel, who alleged that MCPS violated her First Amendment rights by blocking her on X for criticizing the school district. MCPS took away parents’ right to opt their children out of homosexual and “transgender” indoctrination.
The settlement requires MCPS to pay Foldi and Mandel six figures and for the “Staff Pride” affinity group to unblock Mandel on social media. From AFL:
It has also amended its social media policy to explicitly prohibit viewpoint discrimination by MCPS employees, and it will require MCPS staff to certify compliance with all aspects of the policy.
“This settlement sent a message to MCPS and other school districts across the country,” Mandel said in a statement. “Citizens demand transparency and accountability, and a refusal to provide that to journalists and residents has consequences. It’s a shame that it came to this point, but it’s an important victory for common sense in our county.”
MCPS lost at the U.S. Supreme Court on Friday in a different case. The court ruled that taking away parents’ notice of homosexual “instruction” and the option to opt out their children violated the U.S. Constitution.
