Ohio Law Professor Fired for Criticizing Race- and Sex-Based Hiring is Reinstated

A follow-up to a post from January 2024:

A tenured law school professor fired for complaining about race- and sex-based discrimination at Ohio Northern University (ONU) has been vindicated.

According to America First Legal (AFL), Dr. Scott Gerber learned that the hiring committee for new law professors chose candidates based on race and sex. After he criticized the practice, the dean of the law school gave him a choice: resign or be terminated. He refused to resign.

AFL reported that armed security and police officers escorted Dr. Gerber out of the building. He filed complaints with the school and the U.S. Equal Opportunity Employment Commission.

ONU has capitulated. Dr. Gerber will be reinstated, and he will retain his faculty rank and his benefits.

“As part of the settlement, ONU formally acknowledged that: Dr. Gerber was never a public safety risk to any member of the ONU community. He never acted with moral turpitude. He provided ‘outstanding teaching, scholarship, and service’ throughout his tenure at ONU.”

Colleges and universities want to discriminate against individuals based on immutable characteristics like race and sex. They also want to shut down anyone who disagrees.

Dr. Gerber fought for his rights for two years.

“Dr. Gerber should be commended for his courage in filing complaints about what he perceived as ONU’s consideration of race and sex in hiring professors, which is illegal,” Nick Barry, senior counsel at AFL. “This has cost him years of lost teaching opportunity, reputational harm, and the stress of years of litigation. However, his reward is full vindication. He was never a safety threat. He was nothing but an outstanding professor and scholar who stood on truth.”
