Federal Court: Idaho is Free to Enforce Law That Bars Boys from Using Girls’ Restrooms — Protects Privacy and Safety

The Idaho legislature in 2023 passed a bill that bars boys from using girls’ restrooms and locker rooms. Opponents of privacy and safety have fought it ever since.

Two boys filed a lawsuit alleging that the law violated their rights. The girls’ rights didn’t matter to the boys or school officials. As I wrote in 2023, boys and men have no constitutional right to use girls’ and women’s restrooms. A lower court issued an injunction in the case but eventually lifted it.

The Biden administration tried to stop similar state laws from going into effect. The U.S. Department of Education issued a final rule in 2024 that redefined the word “sex” in federal civil rights law to include sexual orientation and “gender identity.”

An appeals court stopped the Biden administration’s attempt to violate girls’ privacy and undermine their safety. The ruling covered Idaho.

Opponents of privacy and safety laws continued to go after Idaho. Alliance Defending Freedom (ADF) recently announced that those efforts have failed. A federal court ruled that Idaho’s ban on boys using girls’ restrooms and changing rooms can be enforced.

ADF quoted from the court’s opinion:

“Separating restrooms by biological sex has been common for centuries…And for good reason—there are biological differences between men and women…Those biological differences are deserving of privacy and S.B. 1100’s segregation of restrooms based on sex is related to that interest.”

Raúl Labrador, Idaho’s attorney general, is pleased with the decision.

“Idaho’s law reflects biological reality, protecting all students’ privacy and safety in school restrooms, showers, locker rooms, and other private spaces,” he said. “This is yet another victory for commonsense and the dignity of women and girls against activists seeking to push a harmful agenda.”
