America First Legal (AFL), founded by Stephen Miller — President Donald Trump’s White House deputy chief of staff for policy and homeland security advisor — filed a lawsuit against the school board on behalf of a female student in Fairfax County Public Schools in 2024 over the district’s “transgender” policy.
The student, who is Roman Catholic, does not want boys in the girls’ restrooms or locker room. She also doesn’t want to lie about pronouns. School officials typically don’t care about girls’ discomfort or safety — just so they can hit all the virtue-signalling points.
Jason Miyares, Virginia’s attorney general, submitted an amicus brief in the case. According to 7 News, the judge allowed the filing over the school board’s objection.
The school board asked a lower court to dismiss the lawsuit. The court refused.
AFL recently announced that the court has again refused to dismiss the student’s lawsuit. An excerpt:
The result of [last Friday’s] hearing means that the case will continue on and the School Board will have to stand trial to defend its policies that allow boys to use female restrooms. The trial is scheduled to begin in late September in Fairfax County.
Will the school board settle?
The Trump administration last month concluded that five Northern Virginia school districts, including Fairfax County’s district, are violating Title IX of the Civil Rights Act of 1964 by discriminating against individuals based on sex.
The school districts are also violating President Trump’s executive order barring schools and educational programs that receive federal funds for not protecting the privacy and safety of girls.
