First Circuit Agrees with Trump Administration — No Medicaid Money for Planned Parenthood

The American Center for Law and Justice (ACLJ) recently announced some good news for pro-lifers and others who don’t want their hard-earned money going to Planned Parenthood.

The Big Beautiful Bill blocks Medicaid funding to any facility that kills unborn babies. Planned Parenthood sued the Trump administration to stop enforcement. A lower court issued preliminary injunctions against the block. The Trump administration asked the U.S. Court of Appeals for the First Circuit to hear the case.

A three-judge panel of the First Circuit last week lifted those injunctions.

“Notwithstanding the contrary conclusion reached by the district court after its careful consideration of the matter, we conclude that defendants have met their burden to show their entitlement to a stay of the preliminary injunctions pending the disposition of their appeals of the same,” the court wrote (PDF).

ACLJ submitted three amicus briefs in the case.

The lift of the injunctions is only temporary. We have much work to do.

“While today’s ruling represents a significant victory, the legal battle is far from over,” ACLJ said. “The appeals of both preliminary injunctions will continue to work their way through the court system. The ACLJ remains committed to supporting efforts to uphold Section 71113 and ensure that it can be fully implemented as Congress intended.”
