H.R. 5, the so-called Equality Act, would amend civil rights laws that bar discrimination based on race, color, religion, sex, and nationality to include “gender identity” and “sexual orientation.” If the measure becomes law, it could impinge on the First Amendment’s religious freedom and free exercise clauses.
Pastor Stephen Broden said the bill “is a clear violation of our constitution.” The measure essentially would nullify the Religious Freedom Restoration Act of 1993, a bill introduced by Senator Chuck Schumer and signed into law by Bill Clinton. This same law protected Hobby Lobby after it sought an exemption to the Obamacare contraception mandate. The U.S. Supreme Court ruled in the Christian retailer’s favor.
