The city council in Naples, Florida, is trying to protect children from inappropriate acts, such as men wearing makeup, wigs, dresses, and heels prancing around in sexually explicit ways. Any reasonable adult would feel the same.
But a certain segment of the homosexual lobby does not feel the same.
The city council voted 5-2 in April to move a proposed drag show from outside at a park that children and parents frequent to inside away from children — and restrict the event to adults only. Needless to say, the organization, Naples Pride, filed a lawsuit to get their way.
From Liberty Counsel:
While Naples Pride characterizes the drag show as “family friendly,” the city avoided challenging this false statement. Several parents of young children who frequent Cambier Park where the festival has been held previously strongly disagree that this show is “family friendly.” In Liberty Counsel’s previous amicus brief, they presented photographic documentation of scenes from a 2022 outdoor show held just 100 feet from the children’s playground. These images depict male performers in obscene drag performing lewd poses and simulating sexual acts that are unsuitable for minors.
The men invited children to put money in their waist bands. And more.
Liberty Counsel represents three parents who seek to intervene in the lawsuit. Naples Pride asked for a preliminary injunction against the city’s restrictions. The city argued that permits to hold events are subject to reasonable and viewpoint neutral criteria.
Liberty Counsel said that this defense doesn’t go far enough. Naples neglected to cite the state’s Protection of Children Act, which expressly bans drag shows from being held in view of minors. A court would be required to deny the injunction if protecting children was a stake.
“Liberty Counsel is intervening in this case to give parents who wish to protect their children from obscene drag performances a fuller defense on the legal and constitutional issues left unspoken by the city of Naples,” said Mat Staver, Liberty Counsel founder and chairman. “The First Amendment does not protect an obscene drag performance in full view of a children’s playground, and Florida law outright bans it.”
