America First Legal (AFL) announced that the U.S. Department of Justice (DOJ) is investigating the University of Virginia (UVA) for violating Title VI of the Civil Rights Act of 1964.
Programs and activities that receive federal funds are barred under Title VI from discriminating on the basis of race, color, sex, or national origin. Americans fought and died during the 1960s civil rights movement for this law.
Despite federal law, executive action, and the U.S. Supreme Court’s ruling in 2023 that declared racial preferences in college admissions unconstitutional, UVA continues to discriminate based on race and sex through diversity, equity, and inclusion (DEI) policies.
AFL sent the DOJ a letter in May informing the department that UVA was still using DEI policies. The school’s board of visitors voted to end these policies, but administrators ignored the vote. From AFL:
“UVA has not dismantled its DEI framework — it has merely rebranded it to evade legal scrutiny. What the law prohibits, UVA simply renamed,” said Megan Redshaw, Counsel at America First Legal. “We are grateful the DOJ has taken our findings seriously and is taking action to hold UVA accountable. No institution that receives taxpayer funds is above the law.”
On X, AFL noted that the titles of DEI employees were changed, but we know their duties are still the same: discriminating against individuals based on immutable characters like race and sex. Hiding DEI violates President Donald Trump’s executive order.
