Alabama’s Governor Just Signed a Bill that Protects Parents’ ‘Fundamental Right’ to Direct the Upbringing of Their Children

The Alabama legislature has made clear that the state prioritizes protecting parents’ rights.

Governor Kay Ivey on Thursday signed AL HB6 into law, which affirms that parents have a fundamental right to direct the education, upbringing, care, and control of their children — as the state’s and the nation’s highest courts have recognized.

The measure bars the government from burdening this fundamental right — unless the government can show that doing so “is narrowly tailored to a compelling state interest and the government uses the least restrictive means possible to further that interest.”

The groundswell of the parents’ rights movement began in earnest after the COVID-19 pandemic. Governor Glenn Youngkin of Virginia rode into office on a wave of parents outraged by school closures, mask-wearing, and what government schools were teaching their kids.

Upon entering office, Gov. Youngkin banned the racially divisive “critical race theory” in government schools.

Loudoun County became a flashpoint in the parents’ rights movement. A father was arrested at a school board meeting after accusing the board of covering up his daughter’s rape. A boy wearing a skirt attacked her in the girls’ restroom. The boy was expelled but sent to a different school, where he sexually assaulted another girl.

A grand jury found that there was no coordinated cover-up, but concluded that school board administrators were looking out for their own interests instead of the interests of the school district. The grand jury also said the sexual assaults could have and should have been prevented.

    Only Dictatorships (Socialists, Communists, Facists, etc) claim the child belongs to the State and removes all rights of the parent.
